The Non-Prosecution Agreement. Southern District of Florida. 2008.
Prosecutors in Acosta's office drafted a 60-count indictment against Jeffrey Epstein — child prostitution, sex trafficking. They planned to arrest him, seize his Palm Beach home, and seize both private jets. Three prosecution memos, now public, document every step.
What emerged instead: a deal. Thirteen months. Work release six days a week. Co-conspirators granted immunity — "known and unknown." Victims not notified, in violation of the Crime Victims' Rights Act. A federal judge confirmed that violation in 2019.
Acosta later told Trump's transition team he was instructed to back off because Epstein "belonged to intelligence." That statement is in the congressional record. It has never been investigated.
60 counts. 13 months. The math is the record.
Sourced from the Non-Prosecution Agreement (2008), Acosta prosecution memos (newly released March 2026), and court filings in Doe v. United States. All public record.
